We set out below the terms and conditions of your use of this website and any orders that you place with us for beauty and other products. By using Our Web Site or by placing an order with us you will be deemed to have read, understood and agreed to be bound by these Terms and Conditions.
Use of Products
You are not recommended to use any of our Products until you have read and understood the relevant instructions provided for them. If you have any questions regarding the use or suitability of any Product please contact us before using the Product and we will be glad to assist you.
By ordering Products from us you agree that you will only use the Products in compliance with the instructions for such Products.
Availability and Delivery
All Products are subject to availability.
We will aim to dispatch all Products on the next working day following receipt and confirmation of payment in full of your order. Any items ordered and paid for in full before 12.00pm will usually be dispatched on the same day.
Our delivery time is usually within 3 days of dispatch.
If a Product is temporarily unavailable we will dispatch the Product on the same day or the day following our receipt of more stock of that item.
If it is not possible to dispatch your complete order for a number of items at the same time, then we will notify you with alternative dispatch arrangements.
All dates and times quoted for delivery are estimated delivery dates and times only and may be subject to change.
If an item you have ordered is no longer available, we will notify you of this as soon as we are able and if necessary, as soon as possible after we have notified you that a Product is no longer available, but in any event no later than 30 days from such notification, we will arrange for the full purchase price of the Product to be refunded or for your credit or debit card to be credited with the full purchase price of the Product.
Payment and Price
The prices for all Products are only correct at the time they are placed on the website and are quoted in pounds sterling (£).
Unless otherwise agreed by us in writing, the price for the Products is the price set out on the latest price list agreed by us on the date of your order.
We will endeavour to ensure that all prices are regularly updated, however if a Product has changed price between the time it was placed on the website, we reserve the right to cancel your order and refund your money. In the case of such refund, we will refund the full purchase price or arrange for your credit or debit card to be credited with the full purchase price, as soon as possible but in any event no later than 30 days from the date we cancel your order.
You must pay the full price of your order before we will send any part of it. We accept online payment in a secure environment, currently Paypal, by credit or debit card.
By paying for a Product you confirm to us that you own the credit or debit card used. All debit and credit card transactions are subject to validation and authorisation by the issuer of the card.
We are not liable for any delay or non-delivery caused by a delay in authorisation by a card issuer or a refusal to pay (whether due to your or our circumstances) by a card issuer.
We retain full title and ownership to any Products you order until we have received payment in full for such Products.
All prices are shown, where appropriate, inclusive of VAT at the current rate and excluding postage, packaging or other delivery charges.
The rate of VAT at the time these Terms and Conditions are published is 17.5%.
Free postage and packing applies only to orders made from inside the United Kingdom.
Banking charges by the receiving bank on payments to us will be borne by us. All other charges relating to payment in a currency, other than pounds Sterling, will be borne by you.
If any of the Products you have ordered are damaged before they arrive at your chosen delivery address, you may return them to us at our expense and once we have received the damaged items we will dispatch new Products to you.
Your Right To Cancel
You may normally cancel your order (once accepted by us) for any reason up to the point of dispatch. If you do cancel the contract within this time any payments made by you will be refunded in full within 30 days.
By law, customers in the European Union have the right to withdraw from the purchase of an item within 7 working days of the day after the date the item is delivered. This applies to all of our Products except for those specially made to order, personalised or altered to fit.
To cancel your purchase within the above 7 working day cooling-off period, please notify us in writing of your wish to cancel your purchase, return the Products to us in their original packaging, undamaged, unused, with the seal unbroken and generally in a re-saleable condition, so that we receive the Products within seven working days of the day after the date that the item was delivered to you.
After we have received the Products and if they are returned in the condition described above, we will credit your credit or debit card with the full purchase price of the goods returned and any delivery charges applied no later than 30 days from the date of receipt.
Please note that you will be responsible for the costs of returning cancelled items to us.
Accuracy of Content
We aim to ensure that all photographs and descriptions are accurate and up-to-date however we reserve the right to cancel any order and refund your money if there is any inaccuracy or omission in the photographs or description of a Product as displayed on the website. In the case of such refund, we will refund the full purchase price or arrange for your credit or debit card to be credited with the full purchase price, as soon as possible but in any event no later than 30 days from the date we cancel your order. Please inform us immediately if you become aware of any such inaccuracies or omissions.
Ownership of Rights
All content on this website belongs to either us, Dermalogica, Inc. the International Dermal Institution or St Tropez Tanning Essentials. You may not reproduce, redistribute, copy, download, repost or alter any of the content, images or coding without our express written consent and the express written consent of the owner of such content, images or code if not us.
Privacy Policy
We respect your right to privacy and value your custom. We will make every effort to ensure than any information held by us about you is kept with the utmost care. We may use information provided by you to provide you with information regarding any special offers or events.
Paypal have similar privacy policies to us however as we do not control their website or computer hardware, we are therefore not responsible for the security of any information held by Paypal.
Limitation of Liability
Afresh Beauty does not seek to exclude or limit liability for death or personal injury arising from its negligence or that of its members, agents or employees or for any fraudulent misrepresentation.
To the fullest extent permitted by law and save as provided above, Afresh Beauty shall not be liable to you by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, or in negligence (whether on the part of Afresh Beauty or any of its members, agents, directors, employees or otherwise) for any indirect, special or consequential loss or damage (including but not limited to loss of profit or loss of saving), loss caused by a virus, loss of data, loss of use costs, expenses or other claims for compensation whatsoever even if we have been advised of the possibility of such damages or losses which arise out of or in connection with the use of this website, any website with which it is linked, the supply of the Products or their use or resale by you. You assume total responsibility for establishing such procedures for data back up and virus checking as you consider necessary.
The entire liability of Afresh Beauty under or in connection with any contract for any Products shall not exceed the price of the Product, except as expressly provided in these conditions.
Governing Law
These Terms and Conditions and your use of our Web Site shall be governed by and construed in accordance with the laws of England and you agree to submit to the non-exclusive jurisdiction of the English courts.
Definitions
"Our Web Site" means the entire computing hardware and software installation that is or supports www.afreshbeauty.co.uk
"Paypal" means PayPal (Europe) Ltd, a private limited company incorporated in the UK and its affiliates.
"Products" means any products offered for sale by us on our website.
"We/Us" means Afresh Beauty, which is owned and run by Jane Dowling.
"You" means any person using Our Web Site or placing an order for Products advertised on Our Web Site.
